2.1 Personal Use (Free)

Retail traders and individual investors are granted the above license to use this Service for personal, non-commercial investment research and decision-making purposes only. This includes:

• Viewing ETF and mutual fund holdings data
• Searching and analyzing fund compositions
• Creating personal watchlists
• Downloading data for personal portfolio analysis

2.2 Institutional Use (Paid License Required)

Institutional users including but not limited to investment advisors, hedge funds, asset managers, financial institutions, research firms, and any entity managing assets on behalf of others must obtain a paid commercial license before using this Service.

Institutional use includes:

• Using data for client advisory services
• Incorporating data into commercial products or services
• Redistributing or sharing data with third parties
• Using data for fund management or institutional trading
• Systematic or bulk data access

3. Acceptable Use

You are prohibited from:

• Using the Site in any way that violates applicable laws or regulations
• Using GetFundHoldings content in a manner that competes with GetFundHoldings products or could serve as a substitute to or otherwise diminish the value of any GetFundHoldings product
• Using GetFundHoldings content on any site or in any way that could reasonably damage GetFundHoldings’ brand or reputation
• For commercial purposes without a valid institutional license
• Posting or transmitting to the Site any content that is unlawful, threatening, libelous, defamatory, obscene or pornographic
• Posting or transmitting any content that contains any viruses, worms, malware, Trojan horses or other harmful, destructive or contaminating content
• Copying, modifying, publishing, transmitting, distributing, transferring, selling, creating derivatives of, or in any way exploiting, any material accessible through the Site, including by use of any robot, spider, scraper, scripting, deep link or other similar automated gathering or extraction tools

All provisions of these Terms which by their nature should survive termination shall survive, including, without limitation, intellectual property ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Resolution of Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of Colorado without application of conflict of laws rules. Most customer concerns can be resolved quickly by contacting us at legal@getfundholdings.com.

INSTEAD OF SUING IN COURT, EACH PARTY AGREES TO ARBITRATE DISPUTES ON AN INDIVIDUAL BASIS. You agree that any dispute, controversy or claim arising out of or relating to any aspect of our relationship and the Services shall be resolved by one arbitrator through binding arbitration. This agreement to arbitrate is intended to be broadly interpreted.

The arbitration of any claim under this Agreement shall be conducted under the rules and procedures of JAMS (www.jamsadr.com). For any non-frivolous claim that does not exceed $10,000 we will pay all costs of the arbitration.

We reserve the right to update or change these Terms at any time by posting the most current version of the Terms on the Site with a new "Last Updated" date shown. Your continued use of the Applications after we post any changes to the Terms signifies your agreement to any such changes.

15. Age Requirement and Severability

You must be at least 13 years of age to use this Site. If you are under 13, you may not access or use the Site. Users between 13-17 must have parental or guardian permission. By using the Site, you represent and warrant that you meet these age requirements.

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not be affected or impaired thereby. The invalid, illegal, or unenforceable provision shall be replaced by a valid, legal, and enforceable provision that comes closest to the intention of the parties underlying the invalid, illegal, or unenforceable provision.
